What Is the DPDPA?
The Digital Personal Data Protection Act, 2023 is India's primary framework governing the processing of digital personal data.
The Act establishes responsibilities for Data Fiduciaries, rights for Data Principals, obligations relating to consent and lawful processing, security safeguards, breach management, children's data, and accountability.
The Act was enacted on 11 August 2023.
The DPDP Rules, 2025 provide additional operational requirements and were notified by the Government of India in November 2025.
Who Needs to Comply With the DPDPA?
The DPDPA can apply to organizations that process digital personal data in India and, subject to the Act's scope, certain processing outside India in connection with offering goods or services to Data Principals in India.
This can include:
- Indian companies
- Global technology companies
- SaaS providers
- E-commerce businesses
- Financial institutions
- Healthcare organizations
- EdTech platforms
- Digital marketplaces
- Advertising and marketing platforms
- AI companies
- Consumer applications
- Data-driven enterprises
Organizations should assess the Act's territorial and material scope based on their specific processing activities.
Data Fiduciary Compliance
Under the DPDPA, organizations that determine the purpose and means of processing personal data can fall within the definition of a Data Fiduciary.
Data Fiduciaries need to establish appropriate governance around:

- Data minimization
- Data accuracy
- Data retention and erasure
- Security safeguards
- Personal-data breaches
- Data Principal rights
- Grievance redressal

DPDPA Data Security
Organizations need appropriate technical and organizational measures to protect personal data.

Assessment
- Determine the nature and extent of the incident.
Notification
- Assess applicable notification requirements and timelines.

The DPDPA establishes additional requirements relating to the processing of children's personal data.
Organizations processing children's data should assess:
- Age-related requirements
- Parental consent mechanisms
- Verification processes

- Social platforms
- Children's applications
- Education providers
- Consumer technology
- Online marketplaces
